IPod Nano users sue Apple

Owners file class-action lawsuit over "excessive scratching"

IPod Nano owner Jason Tomczak and others have filed a class-action lawsuit against Apple in California in an attempt to get their money back for a product which they claim suffers " excessive scratching" during normal use. 

According to Red Herring, the complaint cites several users who have made their feelings known about the tiny devices in blogs and on the web.

The lawsuit demands damages, including the price paid for the Nanos, along with statutory and punitive damages and attorneys' fees. They are also audaciously asking for a share of Nano profits.
